The Colorado Supreme Court on Monday refused to reconsider its ruling overturning a death sentence for convicted murderer Robert Harlan.
The court ruled March 31 that Harlan's death sentence had to be overturned because jurors consulted a Bible during deliberations in the sentencing phase of his trial.
The high court upheld a district court ruling that Harlan should be sentenced to life in prison without parole because jurors may have been influenced by Bible verses brought into the jury room.
Jurors said they discussed passages such as "an eye for an eye and a tooth for a tooth."
The court didn't comment in its decision Monday not to reconsider the case.
Adams County District Attorney Don Quick said he was considering whether to file an appeal with the U.S. Supreme Court.
Harlan, was convicted of kidnapping, raping and murdering Rhonda Maloney, 25, in 1994. He also was convicted of shooting and paralyzing Jaquie Creazzo, a passerby who tried to help Maloney escape.
