Travis Co. Baby Killer To Get Execution Date

(CBS 42) AUSTIN An execution date will be set for the woman convicted of killing a three-month-old Pflugerville boy, and burying his body outside Temple, Texas.

Cathy Lynn Henderson was convicted in 1995 of murdering Brandon Baugh. Her latest appeal was denied.

Back in 1994, Henderson was babysitting for two-year-old Megan and three-month-old Brandon Baugh when she disappeared with baby Brandon. Henderson was later convicted of killing the infant. Now she's just a few days away from finding out when she will die for the crime.

The Cathy Lynn Henderson case shocked Central Texas. She claimed she accidentally dropped Brandon, got scared, and took off running.

Investigators found Brandon’s body buried in Temple along the highway as she fled to her home state of a Missouri. Authorities were led to the site thanks to a map Henderson drew.

The autopsy results were inconsistent with Henderson’s story. She was convicted of capital murder and sentenced to death. Her appeals were denied.

Judge Jon Wisser, who presided over the case more than a decade ago, is now to set to sign Henderson’s death warrant.

Keith Hampton handled Henderson’s initial appeal. He says this case may not be over yet.

“My intention is to ask him not to set a date and wait until that petition has been filed,” Hampton said.

Brandon's parents--Eryn and Melissa-- moved to Dallas. They were not available for comment.

This is a capital murder case because the victim was under five-years-old.

At the time of the murder, Henderson had been babysitting the Baugh children for two months.
