Type III sex offenders are
individuals who have been convicted of a sex offense. Their criminal
history places them in a classification level which reflects the potential
to re-offend.
The
Fargo Police Department is releasing the following information pursuant to
North Dakota Criminal Code 12.1-32-15, which authorizes law enforcement
agencies to disclose sex offender information if the agency determines that
the individual is a public risk and disclosure is necessary for public
protection.
The information
contained here pertains to Level III sex offenders released into
the City of Fargo. This information is also communicated
directly to the affected communities at meetings that give
citizens the opportunity to learn about the notification law,
about the offender being released, the offender's rights and
restrictions, and about what law-abiding people can do to make
themselves, and their families, safer. These meetings also give
attendees an opportunity to ask questions. The materials contained within this site are
not meant to be exhaustive; however, they do provide information about the
notification law and about offenders released into the local community.
Illegal activities against a sex offender
will not be tolerated. These activities could also jeopardize the
notification law.

Level III Sex Offenders Currently Living in Fargo:

Timothy W. Vance
Age 35, 5’11”, 249 lbs., Brown hair, Blue eyes

Offense
background:
Timothy Vance has eight criminal convictions related to improper
sexual contact. All these convictions were for Gross Sexual
Imposition of the same eight year-old daughter of Vance’s then
live-in girlfriend.
In February 1995, Vance pled guilty to eight counts of Gross
Sexual Imposition in Cass County District Court. Vance was
sentenced to 10 years in the North Dakota State Penitentiary.
His sentence started February 22, 1995. Vance was released from
the penitentiary on August 1, 2003. Vance refused sex offender
treatment and failed to accept responsibility for this crime
while in prison. Vance was classified as a high-risk sex
offender by the North Dakota Sex Offender Risk Assessment

Stuart Lee
Sumner
44 years of age
5’10, 200 lbs., brown eyes, black hair

Offense Background:
Sumner has two sex crime convictions. The first conviction was
for Criminal Sexual Conduct in the 2nd Degree in 1994 in
Pennington County, MN. The incident involved fondling over the
clothing of an eight year girl. Sumner was 33 years-old and a
friend of the parents. The second conviction occurred in 2001
for Abusive Sexual Contact in MN. He was sentenced in U.S.
Federal Court to serve 36 months in custody. The incident
involved unwanted sexual contact with a 19 year-old female while
she was asleep. Sumner was 40 years of age at the time of the
offense.
The Fargo Police
Department will conduct a community notification meeting on
March 15, 2005.

Eric Lamar Bristol

Offense Background:
Eric Bristol was convicted of two sex related crimes in 1996 and
1993. In 1996, Bristol was convicted of having sexual contact
with a 14 year-old girl who had passed out in Burleigh County,
North Dakota. Bristol was also convicted of providing alcohol
to a minor in that instance. In 1993, Bristol was convicted of
criminal sexual conduct in the 4th degree. In this
instance, Bristol had sexual contact with a 14 year-old in
Cottonwood County, Minnesota.
The Fargo Police Department conducted
a community notification on May 7, 2003.

Jeffrey Allan Oak

Offense Background: Oak
offended against a juvenile relative on several occasions over
the course of several years. The offenses were alleged to
have occurred from 1992 to 1998. There have been no
additional offenses during the two and one half years that Oak
has registered with the Fargo Police Department.

Wallace Dean
Grant

Offense Background: Grant and another
male had met two girls, aged 16 and 17, and began to drive
around and consume alcohol. They returned to the residence of
one of the men for a party. While at this residence Grant and
the other male were both accused of unwanted sexual contact.
Grant was charged
with sexual assault against both girls. Grant was 27 years of
age at the time of the offense. Grant served 48 days in custody
and the remainder of a year on supervised probation. Grant has
lived in the Fargo-Moorhead area since 1997. Grant has not been
convicted of any sex-related offense since 1997.
The Fargo Police Department conducted a community notification

Jesse A. Kluck

Fargo, North Dakota
Offense Background: In 1995, Jesse
Kluck was adjudicated by Cass County Juvenile Court to be a
delinquent child, guilty of the crime of Gross Sexual
Imposition. This resulted from him having sexual contact with
two girls known to him, ages 11 and 6 years old. Kluck was
placed in the custody of the North Dakota Department of Juvenile
Services.
September
2000: Kluck was released from custody of the North Dakota
Department of Juvenile Services. After
his release, Kluck lived in several different locations and was
convicted of failure to register as a sex offender in
2001. Kluck is on supervised probation with the
North Dakota Department of Corrections. Kluck
moved to Fargo in the spring of 2002 and is now registered with
the Fargo Police Department.

Joseph E. Duncan III

Fargo, North Dakota
Offense Background: On January 24, 1980, in the
City of Tacoma, Washington, Joseph E. Duncan, age 16, committed a burglary
of a neighbor's home. Duncan stole four handguns and ammunition.
That same evening Duncan abducted a 14 year-old boy. The boy had been
walking in Duncan's neighborhood. Duncan sexually assaulted the boy
two times at gun point. He was arrested shortly after the incident.
Duncan was transferred into
adult court at the age of 17. There Duncan pleaded guilty to Rape in
the First Degree for the abduction and sexual assault of the 14 year-old
boy. Duncan was sentenced to 20 years in prison.
September 1994: Duncan was
released on parole after serving 14 years in prison.
April 1997: Duncan was
returned to prison for violating his parole.
July 14, 2000: Duncan was
released from prison after completing his sentence. Duncan was
released without parole or probation.
July 21, 2000: Duncan arrived
in Fargo.
July 24, 2000: Duncan
registered at the Fargo Police Department as a sex offender. The Fargo
Police Department evaluated Duncan. Based on the history, profile, and
the Minnesota Sex Offender Screening Tool-Revised score, Duncan was classified
as a Level III sex offender.
September 27, 2000: The Fargo Police Department conducted
a community notification. (Posted
